DTV LIVE Platforms Limited ("JPL" "Company" "we", "our", "us") having its registered office at 101- Saffron, Near Centre Point, Panchwati Rasta 5, Ambawadi, Ahmedabad, Gujarat 380006, India and its local office at 3rd Floor, Maker Chamber IV, 222 Nariman Point, Mumbai - 400021, operates the DTV LIVE App (hereinafter referred to as "Application", "Service" or "DTV LIVE" as in the Terms of Use) for the users ("you" / "your" / "yourself").

Your privacy is important to us. Please read the following privacy policy ("Privacy Policy") to learn about our information gathering and dissemination practices in connection with your use of Application.

The terms of this Privacy Policy, read with the Terms of Use , disclaimers, and all other policies and rules as may be posted on this Application (all of which are included herein by reference and form an integral part of the terms) govern your use of the Application and the information accessible on or from the Application. The Terms of Use along with this Privacy Policy govern all use of Application and collectively constitutes a binding and enforceable agreement between you and us.

This Privacy Policy is subject to modification based on changes in the business, legal and regulatory requirements and will be made available to you on the Application. We reserve the right, at Our sole discretion, to change, modify or otherwise alter this Policy at any time with or without prior notice (to the maximum extent permissible under law). We will never ask you and you must never provide sensitive personal data or information to us or to any person/entity representing the Company. Any disclosure of sensitive personal data or information shall be at your sole risk and without any liability to the Company (including its directors, key managerial personnel, officers and employees). You understand, acknowledge and agree that the Company or any other person acting on behalf of the Company shall not in any manner be responsible for the authenticity of the personal information or sensitive personal data or information provided by you to the Company.

You must not disclose your following sensitive personal data/ information:

ii. Financial information such as bank account details, credit card details, debit card details, secure pin number, passwords, etc.;

iii. Physical, physiological and mental health condition;

iv. Sexual orientation;

v. Medical records and history;

vi. Biometric information;

vii. National identification numbers;

viii. and such other sensitive personal data or information.

However, Users must note that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Personal Information or Sensitive Personal Data or Information for the purposes of this Policy and the Company shall not be obliged to take any measures to protect the same since the same is freely available in the public domain.

Please note that identity theft and the practice currently known as "phishing" are of great concern to the Company. We do not and will not, at any time, request Your credit card information/debit card information/financial pin numbers/ Payment Methods and passwords etc. If the Service is available to access by making a payment of subscription fee, then such information (only to the extent necessary) shall be collected, stored and/ or processed by the third-party payment gateway directly, without any access to the Company to any such payment information. User shall then be governed by the terms of use of such third-party payment gateway. Similarly, where you pay a third party application/ service provider for your subscription package as part of an in-app or bundled purchase (for eg. Apple, Amazon, etc.) your payment information is directly collected and controlled by that third party. The Users are expected to read and fully understand the privacy policy of such third-party payment gateway or third-party service providers, as the case maybe, before sharing any information with such third-party payment gateway. Other than providing a confirmation upon receipt of payment from You against Your Account, the Company disclaims all liabilities in relation to Your payment processing by such third-party payment gateway and/ or third-party service provider, as the case maybe, and the collection and processing of any payment information provided by You to such party(ies). You agree and acknowledge that the Company shall not be liable or and in no way be held responsible for any losses whatsoever, either direct, indirect, incidental, or consequential/special, including without limitation any losses due to delay in processing of payment instruction or any credit card/debit card/banking/ payment fraud.

4. Information Collection and Use

When we use the Application, we collect several different types of information for various purposes to provide the Application services and improve the Application for you as detailed in section 5 below. By visiting/accessing the Application and/or using the services, you agree to provide us with information as detailed in clause 5 and 6 below, and you are consenting us to use the information in accordance with this Privacy Policy.

We may also obtain information collected by cookies or similar technologies (as described below), through contest and promotions held by the Company, newsletter subscriptions, enrollment for promotions, campaigns, special offers, surveys, feedback, analytics, research, information posted in social communities on the Service, etc. or otherwise shared on the Service.

We may also obtain information collected as a result of You hosting, displaying, uploading, modifying, publishing, transmitting, updating and sharing User Materials in any on the Service.

We may also obtain information about You, from any e-mails, letters, communication, etc. that You send to Us.

If You access the Service through a social media platform, We may collect Your user ID or user-name, and/ or any other information You have permitted the social media service to share with Us, and any information You have made public with the social media service. In such a case, You undertake to comply to the Terms of Use (ToU) including the Policy of the Service and any additional terms and conditions stipulated by such social media platforms. In the event of any inconsistency, the ToU including the Privacy Policy of the Service shall prevail to the extent of conflict.

We may combine Your personal information with information collected from tracking technologies and aggregate it with information collected from other Users using the Service to attempt to provide You with the services and a better experience on the Service. You understand, agree and acknowledge that Our collection, storage and processing of Your personal information is for a lawful purpose connected with the functioning of the Service. Telemetry Data Telemetry Data shall mean all information and data that the Application generates in connection with your usage, including but not limited to, network policy, log and configuration information; threat intelligence data, URLs/Websites metadata or net flow data; origin and nature of malware; the types of software or Websites installed on a network/device or an endpoint; information about the devices connected to a network; information generated by sensors, devices and machinery; information related to the usage, origin of use, traffic patterns or behavior of the users of a network or Application; and information relating to the existence of cookies, web beacons, and other similar Websites.
Tracking Cookies Data We use cookies and similar tracking technologies to track the activity on Application and we hold certain information. Cookies are files with a small amount of data which may include an anonymous unique identifier. The tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse Application. 6. Use of Data

You may need to provide the Company with Your Personal Information while registering Yourself on any of the Service. The information so provided by You to the Company or otherwise captured by the Company may be used for a number of purposes connected with the Company business operations which may include the following:

We use the collected data for various purposes as mentioned below:For completing your Account creation/ registration processes, including providing One Time Password (OTP) on Your registered mobile number for activating Your Account on the Service, and similarly providing OTP on Your registered mobile number when You log out of the Service and want to again sign-in/ log into the Service;
Verifying your identity, access, privileges assigned and relationship with us for using the Application;
to provide access to Content and maintain the Application;
to provide personalized Content and recommendations on the basis of your interests and needs;
For the purposes of our internal record keeping;
Support to law enforcement agencies or in connection with an investigation on matters related to public safety or for compliance with law;
JPL may (and you authorize JPL to) disclose your name, street address, city, state, pin/zip code, country, phone number, email, social media account(s) and company name to intellectual property right's owners, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity;
to notify you about changes to Application;
to allow you to participate in interactive features of Application when you choose to do so;

to gather analysis or valuable information so that we can improve Application;
to monitor the usage of Application;
to detect, prevent and address technical issues on the Application;

To share with Our affiliates and group companies to perform any services on our behalf and, to market/ promote other services and products generally offered by us, our affiliates and group companies;
To communicate with You concerning the Service so that we can send you updates about Service, details about new features and content available on our Service, transactional messages (such as subscription renewal reminders, payment failure triggers etc.), special offers, promotional announcements, consumer surveys, and to assist you with operational requests such as password reset requests. These communications may be by various methods, such as email, push notifications, WhatsApp, text messages. We use Non-personal data/information to inter-alia deliver our web pages to You upon request, to tailor our Service/website to the interests of our users, to understand and analyze trends, to administer the Service, to learn about user behavior on the Service, to measure traffic within our Service/website, to improve the Service/website quality, functionality and interactivity and let advertisers know the geographic locations from where our visitors come.

We may use "cookies", web beacons, log data or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the user's individual interests using the identified computer. Unless You voluntarily identify Yourself (through registration, for example), We will have no way of knowing who You are, even if We assign a cookie to Your computer. Further, any comments, messages, blogs, scribbles etc. posted/uploaded/conveyed/communicated by Users on the public sections of the Service becomes published content and is not considered personally identifiable information subject to this Policy.

7. Retention of Data

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies. Once the purposes are achieved, all Personal Data is deleted in a safe and secure mode. Nothing set out herein shall apply to the anonymized, aggregated datasets generated by any information provided through the Service or any reports, or other visualization created using such datasets.

We will also retain Telemetry Data for internal analysis purposes. Telemetry Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of Application or we are legally obligated to retain this data for longer time periods. Nothing set out herein shall apply to the anonymized, aggregated datasets generated by your data provided through the Application or any reports, or other visualization created using such datasets.

Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

The Company does not sell or rent Personal Information. Personal Information may be disclosed under the following circumstances:

Service may present display advertising and may collect data about traffic via DTV LIVEAds, demographics and interest reporting.

10. Security of Data

The Company uses commercially reasonable security measures, practices and procedures, at the minimum those mandated under the Information Technology Act, 2000 as amended and read with Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to safeguard and protect Your data and information. The Company implements such measures, as stated above, to protect against unauthorized access to, and unlawful interception of, Personal Information. You accept the inherent security implications of providing information over Internet/ cellular/data networks and acknowledge that we cannot ensure, warrant or guarantee the security of Your data/ information while it is being transmitted to our Service.

The security of your data is important to us. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security and that any information that you transmit to us is at your own risk. We assume no liability for any disclosure of information due to errors in transmission issues, unauthorized third-party access to the Application and data bases or other acts of third parties or acts or omissions beyond our reasonable control and you shall not be entitled to hold us responsible for any breach of security except in case of wilful negligence on our part.

Your information or data will primarily be stored in an electronic form. However, certain data can also be stored in physical form. The Company may store, collect, process and use Your data in countries other than the Republic of India but under full compliance with applicable laws. The Company may enter into agreement with third parties (in or outside of India) to store Your information or data. These third parties may have their own security standards to safeguard Your information or data and the Company will endeavour on commercial reasonable basis to require such third parties to adopt reasonable security standards to safeguard Your information / data.

Notwithstanding anything contained in this Policy, the Company shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" shall mean any event that is beyond the reasonable control of the Company and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

11. Access, correction and Deletion

The Company provides You with all information that the Company maintains about You such as the transaction and contact information upon proper verification. This may be provided to You on request, in case You experience any doubts. You may request access and/or correct the information, the Company has collected from You by contacting the Company at [email protected]. If You wish to have the information or data that You have provided to the Company deleted, You can always do so by sending a request to Us on the aforesaid e-mail id. You may note that correction or deletion of certain information or data may lead to cancellation of Your registration with the Service(s) or Your access to certain and/ or all features of the Service(s). You also agree and acknowledge that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings, or for archival/ data retention/ record keeping purposes .

12. Service Providers

We may employ third party companies and individuals to facilitate Application ("Service Providers"), provide service on our behalf, perform related services or assist us in analysing how our service is used through the Application.

These third parties may have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose. They are bound by their legal and regulatory obligation for providing services like the phone number used for accessing the Application or for providing customer care services, bill collection services, hardware delivery services, courier services etc.

13. Links to other site

The Service/website may include links to other websites/applications. Such websites/application are governed by their respective privacy policies, which are beyond our control. Once You leave our servers (You can tell where You are by checking the URL in the location bar on Your browser), use of any information You provide is governed by the privacy policy of the operator of the website/application You are visiting. That policy may differ from ours.

We strongly advise You to review the privacy policy of every site/application You visit. We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites/application or their services. 14. Grievances

Push Notifications: - You can choose to receive mobile push notifications from the Company. On some device operating systems, You will be automatically enrolled in the notifications. If You subsequently decide You no longer wish to receive these notifications, You can use Your mobile device's settings functionality to turn them off. We also offer push notifications on certain web browsers. If You agree to receive those notifications and subsequently decide You no longer wish to receive these notifications, You can use Your browser's settings to turn them off.
WhatsApp: - If You no longer wish to receive WhatsApp messages in connection with your account, then You can use “opt-out” mechanism available on the welcome message sent by Us, reply STOP or You can either use Your WhatsApp application settings functionality to block.
